Terms and Conditions of Use - Stampway

1. Identity and Contractual Relationship
The Stampway application is operated by Ana Borda, an individual developer based in Colombia (hereinafter 'the Owner'). By using the Application, you agree to these Terms, which are complemented by our Privacy Policy.
2. Corporate Evolution and Assignment
The Owner reserves the right to assign the ownership of the Application and this contract to a future legal entity (company) incorporated in Colombia or abroad, without requiring additional user consent, while maintaining the established data protections.
3. Use of the Application and Minimum Age
Stampway is not intended for users under 13 years of age (or 16 in the EU). Use by minors must be supervised by a legal guardian. Users are responsible for maintaining the security of their access credentials.
4. Third-Party Services and Data Transfer
For its proper functioning, Stampway utilizes external providers including Firebase (storage), Cloudinary (images), Amplitude (analytics), and RevenueCat (subscriptions). By using the App, you acknowledge that your data may be transferred to and processed outside your country of residence, including the United States, under the security measures described in the Privacy Policy.
5. User-Generated Content (UGC)
You retain ownership of your photos and notes. However, Stampway strictly prohibits the storage of illegal, pornographic, defamatory content or content that infringes on intellectual property rights. The Owner enforces a zero-tolerance policy, removing such content and suspending infringing accounts immediately.
6. Subscriptions, Payments, and Refunds
All transactions are processed through the official Apple App Store and Google Play Store payment gateways. The Owner does not store credit card information. Refunds and cancellations are governed exclusively by the policies of the respective app stores.
7. Limitation of Liability
The Application is provided 'as is'. The Owner does not guarantee the absolute accuracy of geolocation data or the uninterrupted availability of the third-party services mentioned in Clause 4.
8. Account Deletion and Data Retention
You may delete your account at any time. In accordance with our Privacy Policy, personal data will be removed from our active systems within a maximum period of 30 days following the deletion request.
9. Governing Law and Jurisdiction
This agreement is governed by the laws of the Republic of Colombia. Any dispute shall be submitted to the courts of Colombia, unless the local law of the user requires a different jurisdiction for consumer protection matters.
